Last week the commission for setting federal sentencing rules did something unheard of. It is asking for the public's advice on a formula to sentence those committing computer crime in the US.
There is a point system that the USSC uses called the Federal Sentencing Guidelines, which sets the value for a particular crime and then adds or subtracts these points by eater vexing or mitigating circumstances

Kevin Poulsen gives a good example as to how this works in other cases here. The reasoning behind the new "formula" is due to the new Homeland Security Act, in the revision of computer offense laws. And the fact that today's computer laws are in addition to three or four other "Federal Sentencing Guidelines."

You can find the notice that the USSC released from their web site here.

There is also a list of questions that the commission is asking the public, in PDF format here.

All submissions should be presented by Feb 18 2003
