Port scanning is NOT ILLEGAL!!! Say you were looking for a shell account or such, or you had some proxy program that would scan pot 80, 8000,8888, 3182 would that be illegal? No. Port scan all you like there's nothing wrong with it, unless they say you're acting suspicious or some shit... :D
