I had a similar problem to this one at one stage, though it was when i upgraded from 98 to XP and my burner didn't work. Try updating your ASPI layers, you can get these from the Roxio/Adaptec site and probably the nero site as well.

Also, try Clone CD as i know that the ASPI layers come with the latest version of it.
