Is War driving Illegal?

Category
Law
Summary
I just read an article on the register stating a person, a security analyst at that, in Houston is being charged for ?hacking? a wireless network belonging to a county court in Houston, because he was trying to demonstrate to a city official that the coun
Body
This ticks me off because:

1. RF frequency is free to pick up. It's just like listening to a radio for Christ sakes! There is no law that say's that receiving a RF transmission is against the law. Their for war driving is LEGAL unless you go beyond receiving the transmission(s) and start breaking into the systems on the wireless network, then that would make it illegal.

2. This person, from the article, was trying to help the county court secure their network by demonstrating that they had a vulnerable WLAN.

He shows a city official that a county court was vulnerable and the city thanks him by throwing him in jail? WTF is the USA's government coming to? This is total absolute BS! I personally will be following this story closely. If convicted then it will mean that war driving IS illegal and people that war drive as a hobby are breaking the law. IMHO if the government is going to make war driving illegal, then the government is going to have to make listening to the radio against the law also because it's technically the SAME THING!
